As part of your booking, our studio requires a signed contract that outlines the experience as well obtaining permission to photograph you. Please review and sign below to complete your booking. 

1. Retainer + Payment

The Client shall make a non-refundable retainer ($amount varies according to session) for Trish Hadley Boudoir (Photographer) to perform the services specified herein. Upon payment, Photographer will reserve the time/date agreed upon by both parties. Client agrees that this retainer is earned by Photographer when paid, and is remitted in consideration of the experience, reputation, skill of the Photographer, and in consideration of the inability of the Photographer to schedule other clients during this time. Payment for product orders shall be submitted to the Photographer at the scheduled ordering appointment (1-2 weeks after the session) whether via online proofing appointment or in-person viewing. Any payment plan agreements agreed to by the Photographer and the Client shall be included as an addendum to this Contract. No products shall be delivered until the entire amount is paid in full.

2.  Cancellation/Rescheduling/Late Arrivals

In the event Client requests to reschedule their session appointment, Trish Hadley Boudoir will provide one complimentary reschedule which must take place within 6 months. If Client fails to show, cancels before the agreed upon event date or is more than 30 min late in arrival, retainer is subject to forfeit.

3.  Investment Menu

The Photographer must submit a list of pricing prior to the Ordering Session and charges are based on the Photographer’s Investment Menu. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

4.  Use of Independent Contractor

Photographer will furnish a hair and/or makeup artist, and Photographer is not liable for any application or services by this Independent Contractor. This includes, but is not limited to, allergies as a result of use of the products by the Independent Contractor. It is the Client’s responsibility to convey all allergies to the Independent Contractor.

5.  Use of Alcohol

The use of alcohol IS permitted on the Photographer’s premises, however the Client understands that consumption of alcohol prior to and/or during the session may negatively impact the results of the images.

6.  Copyright/Reproduction/Client Usage

Photographer shall retain copyright ownership of all works created in the course of this Contract, including but not limited to all images in their original and processed formats. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of the Photographer. Alterations include, but are not limited to, application of filters, cropping, or modifications of any kind. The Client shall only use the photographic prints, including digital files, in accordance with the permissions within this Contract. The Client’s prints are for personal use only and shall not be submitted to contests or reproduced for commercial use.

7.  Failure to Perform

If Photographer is unable to perform this Contract due to illness, emergency, fire, casualty, strike, state of emergency order, act of God or causes beyond the control of the Photographer, the Photographer and the Client shall make every attempt to reschedule the session within the current shoot availability of the Photographer. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to the equipment operation and image processing, or photographic materials are otherwise lost or damaged without fault of the Photographer, liability shall be limited.

8.  Indemnification

The Photographer shall be held harmless for any and all injury to the Client and the Client’s property during the course of the photography session and the immediately surrounding events.

9.  Miscellany/Attorney’s Fees/Construction

This Contract shall be governed by the laws of the State of Michigan. If either party to this Contract brings a legal action against the other party to this Contract, the prevailing party shall recover reasonable attorney’s fees and all costs, premiums for bonds, fees, and other expenses expended or incurred in the action in addition to any other relief that may be awarded. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in interpreting this Contract. The language in this Contract shall be interpreted as to its fair meaning and not strictly for or against any party.

8.  Addendum: Covid-19 Release of Liabilty

Due to the 2019-2020 outbreak of the novel Coronavirus (COVID-19), Trish Hadley Boudoir is taking extra precautions with the care of every client to include enhanced sanitation/disinfection procedures in accordance with federal and state health safety guidance. Client must enter the premises with an approved mask and not be accompanied by any third parties and affirm that they have not been exposed to anyone diagnosed with Covid in the last 15 days. Trish Hadley Boudoir cannot guarantee Client will not become infected with COVID-19. and Client must be aware that attending a photoshoot could increase the risk of contracting COVID-19.
