BODY LOVE PROJECT: CONTRACT + RELEASE 

As part of your this project and your scheduled shoot, our studio requires a signed contract/release that outlines: the expectations of the experience, use of the images and permission to photograph you. Please review and sign below. We look forward to working with you!

1. Reservation Fee + Payment

The Body Love Project Participant(BLPP) shall make a non-refundable reservation fee (amount pertained to either a Featured Shoot or a Body Love + Boudoir Shoot) for Trish Hadley Boudoir (Photographer) to perform a photography shoot and generate images specified herein. Upon payment, Photographer will reserve the time and date agreed upon by both parties. BLPP understands that images are a separate and optional purchase as the shoot does not grant BLPP ownership or use to images from the session.

2.  Cancellation/Rescheduling/Late Arrivals

In the event BLPP requests to reschedule their scheduled session, it is understood that due to the limited time slots available, Trish Hadley Boudoir has full permission in choosing to reschedule the session or not reschedule. If BLPP fails to show or cancels before the agreed upon photographic event date, or the session is cancelled, reservation fee shall be forfeited. Any BLPP that is more than 20 minutes late arriving to the scheduled session time is subject to cancellation and forfeit of reservation fee. 

3.  Image/Product Price List

The Photographer must make a full price list available to the BLPP regarding the possible purchase of images at the viewing/ordering session. Pricing for this event is promotional and based off of the Photographer’s Standard Price List. 

4.  Use of Independent Contractor

Photographer will furnish a hair and/or makeup artist, and Photographer is not liable for any application or services by this Independent Contractor. This includes, but is not limited to, allergies as a result of use of the products by the Independent Contractor. It is the BLPP’s responsibility to convey all allergies to the Independent Contractor.

5.  Use of Alcohol

The use of alcohol IS permitted on the Photographer’s premises, however the BLPP understands that consumption of alcohol prior to and/or during the session may negatively impact the results of the images.

6.  Copyright/Reproduction/BLPP Usage

The Photographer shall retain copyright ownership of all works created in the course of this Contract, including but not limited to all images in their original and processed formats. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of the Photographer.  Should the BLPP choose to purchase images for personal use, alterations forbid the application of filters, cropping, or modifications of any kind and images shall not be submitted to contests or reproduced for commercial use.

7.  Failure to Perform

If the Photographer is unable to perform scheduled shoot due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and the BLPP shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, the Photographer shall return the reservation fee to the BLPP and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to the equipment operation and image processing, or photographic materials are otherwise lost or damaged without fault of the Photographer, Photographer will return the reservation fee and liability will be limited.

8.  Indemnification

The Photographer shall be held harmless for any and all injury to the BLPP and the BLPP’s property during the course of the photography session and the immediately surrounding events.

9.  Miscellany/Attorney’s Fees/Construction

This Contract/Release incorporates the entire understanding of the parties. Any modifications of this Contract/Release must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Contract. This Contract shall be governed by the laws of the State of Michigan. If either party to this Contract brings a legal action against the other party to this Contract to secure the specific performance of this Contract, collect damages for breach of this Contract, or otherwise enforce or interpret this Contract, the prevailing party shall recover reasonable attorney’s fees and all costs, premiums for bonds, fees, and other expenses expended or incurred in the action in addition to any other relief that may be awarded. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in interpreting this Contract. The language in this Contract shall be interpreted as to its fair meaning and not strictly for or against any party.

10.  Use of Images/Release

The purpose of Trish Hadley Boudoir’s participation in the Body Love Project is to create images of the female human body and utilize those images for promotion of Body Love Project both online and at the Fab + Fierce event on May 6 in Midland, Michigan. The BLPP agrees to the usage of those images generated from their session in said promotions and events. Should BLPP request to have any images removed, Trish Hadley Boudoir is not under any requirement or obligation (see Copyright, item #6) to submit to that request.
